Double Minimum Punishment Laws in Alabama

Alabama’s Double Minimum Punishment Law greatly affects those found guilty of driving under the influence (DUI). This legislation, passed in 2011, severely penalizes those measuring a blood alcohol content of .15% while driving on Alabama roads.

Individuals found with this level of blood alcohol content (BAC) or higher, if convicted, are subject to sentences of doubled fines and doubled jail time. Additionally, these drivers face a year long license suspension. These penalties also apply to those convicted in Alabama of a DUI while driving with children under the age of 14 in the vehicle, regardless of the BAC measured during the time of arrest.

In order to reinstate their Alabama driver's license following a DUI conviction, citizens must additionally complete a substance abuse course. And even once their licenses are reinstated, many are then required to purchase blood alcohol ignition interlock devices for their vehicles.
